Terms of Use

These Terms of Use (“Terms”) govern your use of the Pickflix iOS application and the website www.pickflix.ai (together, the “Service”), operated by [Legal entity name] (“Pickflix”, “we”, “us”). By downloading, installing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What Pickflix is (and isn’t)

Pickflix is a discovery tool. It recommends movies and series based on your preferences and shows you where they are reported to be available to stream, rent or buy in the country you select. Pickflix does not host, stream, sell or license any movies or series. Watching a title requires your own subscription or purchase from the relevant third-party service.

2. Eligibility and accounts

• You must be at least 13 years old (or the minimum age required in your country) to use the Service.
• You can use Pickflix without creating an account; your data is tied to an anonymous device profile. Optionally you may sign in with Apple to sync across devices.
• You are responsible for keeping your device and Apple ID secure and for all activity under your profile.
• You may delete your profile at any time from Profile → Delete account.

3. Free tier and Premium subscriptions

Free tier

New users receive 10 free AI picks and 10 free streaming searches. We may change the free allowance in the future, and we may apply reasonable measures to prevent abuse of the free tier (for example by repeatedly resetting devices).

Pickflix Premium

• Premium unlocks unlimited AI picks and searches and additional features, for $4.99 per month or $29.99 per year (or the equivalent shown in the App Store for your country, which may vary by region and currency).
• Auto-renewal: Premium is an auto-renewing subscription purchased through Apple’s App Store. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically at the same price unless you cancel at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends.
• Cancelling: You manage and cancel subscriptions in your iPhone’s Settings → [your name] → Subscriptions. Deleting the app does not cancel a subscription. Cancellation takes effect at the end of the current billing period; you keep Premium until then.
• Refunds: Purchases are processed by Apple and refunds are governed by Apple’s policies. You can request a refund at reportaproblem.apple.com. [LAWYER REVIEW: statutory withdrawal rights for EU/Turkey consumers.]
• Free trials or promotions, if offered, convert to a paid subscription unless cancelled before the trial ends; the details are shown at the time of purchase.
• Price changes: If we change the price, Apple will notify you in advance and, where required, ask for your consent before the new price applies.

4. Recommendations and availability accuracy

• Recommendations are generated by an AI model ranking titles retrieved from third-party databases. They are suggestions, not guarantees that you will like a title, and they may occasionally be imperfect.
• We do not guarantee the accuracy, completeness or timeliness of streaming availability, prices, runtimes, ratings or any other metadata. Catalogues change daily and our data providers may lag. Always confirm availability and price on the streaming service itself before subscribing or paying.
• Match percentages are estimates derived from your stated preferences and history; they are not an objective measure of quality.

5. Third-party services and content

• Metadata and images are provided by TMDB. This product uses the TMDB API but is not endorsed or certified by TMDB.
• Streaming availability data is provided by JustWatch.
• AI ranking uses models from Anthropic.
• Streaming services (Netflix, Prime Video, Disney+, Max, Apple TV+, MUBI, TV+, BluTV, TOD, Exxen, Gain and others) are independent companies and their names are trademarks of their owners. Pickflix is not affiliated with, endorsed by or sponsored by any of them. Your use of those services is governed by their own terms.
• When you tap a link that opens a third-party app or website, you leave the Service. We are not responsible for third-party content, availability, pricing or practices.

6. Acceptable use

You agree not to:

• reverse engineer, decompile or extract the source code of the app except where the law expressly permits;
• scrape, bulk-download or redistribute data obtained through the Service, or use it to build a competing dataset or service;
• circumvent the free-tier limits, subscription checks or any security measure;
• use automated tools to access the Service at volumes beyond normal personal use;
• use the Service for any unlawful purpose or in a way that harms other users or us.

7. Intellectual property

The Pickflix name, logo, app, website, design and original text are owned by us and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, in accordance with these Terms and Apple’s usage rules. Movie titles, posters and related material belong to their respective rights holders and are shown for identification purposes only.

Feedback you send us may be used to improve the Service without any obligation to you.

8. Termination

You can stop using the Service at any time and delete your profile in the app. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service; where reasonable we will give notice. Sections 4, 5, 7, 9, 10 and 13 survive termination.

9. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free or that recommendations or availability data will be accurate. Nothing in these Terms limits rights that consumers have under mandatory law.

10. Limitation of liability [LAWYER REVIEW]

To the extent permitted by law, Pickflix will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of or inability to use the Service, including reliance on any recommendation or availability information. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Some jurisdictions do not allow these limitations, in which case they apply only to the extent permitted.

11. Apple-specific terms

These Terms are between you and Pickflix, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to the app or your use of it, including product-liability claims, legal-compliance claims or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited parties.

12. Changes to the Service or Terms

We may modify or discontinue features, and we may update these Terms. Material changes will be announced in the app or on this page with a new effective date. Continued use after the effective date constitutes acceptance.

13. Governing law and disputes [LAWYER REVIEW]

These Terms are governed by the laws of [Country / jurisdiction], without regard to conflict-of-law rules, and the courts of [City, Country] have exclusive jurisdiction, except that consumers in the EU, UK and Turkey retain the protection of mandatory rules and the courts of their country of residence.
